Contested vs Uncontested Divorce
Contested divorce is any divorce where the two parties have one or more items on which they cannot agree--it could be financial, real estate, or how to arrange child custody. Contested cases are the ones where the process is often arduous and drawn out--often costly and frustrating. In some rare cases, they may even go to litigation.
If both parties do not wish to be married and have a general consensus on how to divide assets, they may be candidates for uncontested divorce. Both parties should be willing to work together for an equitable and fair settlement. This can help keep unneeded stress and costs out of divorce and be a more civil way to start anew.
Mediated Divorce
If a divorce is contested, mediation provides a less confrontational solution versus going through litigation. This process allows both parties, and their attorneys, work with a mediator to find a compromise for their binding mutual agreement. This can be a faster, more cost effective solution rather than going through the courts for your case. The parties are still able to use a financial professional as a part of the divorce team to ensure that all financial and tax implications are considered for the parties.
